1. Introduction & Acceptance1. المقدمة والقبول

Welcome to Mustaqir ("Mustaqir", "we", "us", or "our"). Mustaqir is a Saudi short-term rental operator that lists, markets, and operates residential properties on behalf of their owners across the Kingdom of Saudi Arabia, and offers these properties for short-term stays to guests ("Guests"). مرحباً بك في مستقر ("مستقر"، "نحن"). مستقر مُشغّل سعودي للإيجارات قصيرة الأجل، يُدرج ويسوّق ويُشغّل العقارات السكنية نيابةً عن ملاكها في جميع أنحاء المملكة العربية السعودية، ويعرض هذه العقارات للإقامة قصيرة الأجل للضيوف ("الضيوف").

By creating an account, engaging us to operate your property, making a booking, or using our website and services in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the services. باستخدام خدماتنا — سواء بإنشاء حساب أو تكليفنا بإدارة عقارك أو إجراء حجز أو بأي طريقة أخرى — فأنت توافق على الالتزام بهذه الشروط وسياسة الخصوصية. إذا كنت لا توافق، يُرجى عدم استخدام الخدمات.

2. Account Registration & Eligibility2. التسجيل والأهلية

To use most features of Mustaqir, you must register an account. By registering, you confirm that: للاستفادة من معظم خدماتنا، يجب إنشاء حساب. وبتسجيلك تُقرّ بما يلي:

• You are at least 18 years of age and legally capable of entering into binding contracts;أن عمرك لا يقل عن 18 عاماً وأنك مؤهل قانونياً للدخول في عقود ملزمة؛
• The information you provide is accurate, complete, and kept up to date;أن المعلومات المقدمة دقيقة وكاملة ومُحدّثة؛
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account;أنك مسؤول عن سرية بيانات تسجيل الدخول وعن جميع الأنشطة التي تجري عبر حسابك؛
• You will notify Mustaqir immediately of any unauthorized use of your account.ستُبلغ مستقر فوراً عن أي استخدام غير مصرّح به لحسابك.

Property Owners must complete a verification process (Know Your Customer / KYC) and sign a Property Management Agreement with Mustaqir before their properties can be listed. يلتزم ملاك العقارات باستكمال التحقق من الهوية (اعرف عميلك / KYC) وتوقيع اتفاقية إدارة عقار مع مستقر قبل إدراج أي عقار.

3. Role of Mustaqir3. دور مستقر

Property Owners ("Owners") engage Mustaqir under a Property Management Agreement to list, market, price, manage bookings for, and operate their properties on Mustaqir's website. Under this arrangement: يتعاقد ملاك العقارات ("الملاك") مع مستقر بموجب اتفاقية إدارة عقار، تُكلّف مستقر بإدراج العقارات وتسويقها وتسعيرها وإدارة حجوزاتها وتشغيلها على موقع مستقر. وبموجب هذا الترتيب:

• Mustaqir's authorized employees handle all aspects of listing creation, photography review, pricing strategy, calendar management, guest communication, booking approval, check-in/check-out coordination, cleaning logistics, and dispute handling;يتولى موظفو مستقر المعتمدون جميع جوانب إنشاء الإعلان، ومراجعة الصور، وإستراتيجية التسعير، وإدارة التقويم، والتواصل مع الضيوف، والموافقة على الحجوزات، وتنسيق الدخول والخروج، ولوجستيات التنظيف، ومعالجة النزاعات؛
• Owners have view-only access to their property's performance via the Mustaqir dashboard;يحظى الملاك بصلاحية الاطلاع فقط على أداء عقاراتهم عبر لوحة تحكم مستقر؛
• Mustaqir, acting as authorized operator, is a party to the rental agreement with each Guest. The rental contract is between Mustaqir (operating on behalf of the Owner) and the Guest;يُعتبر مستقر — بصفته المُشغّل المعتمد — طرفاً في عقد الإيجار مع كل ضيف. ويبرم عقد الإيجار بين مستقر (نيابةً عن المالك) والضيف؛
• Revenue is collected by Mustaqir and remitted to Owners less Mustaqir's management fee, in accordance with the Property Management Agreement.تتحصل مستقر على الإيرادات وتُحوّلها إلى الملاك بعد خصم رسوم الإدارة، وفقاً لاتفاقية إدارة العقار.

Guests deal directly with Mustaqir for all aspects of their stay — booking, payment, communication, check-in support, and post-stay matters. يتعامل الضيوف مباشرةً مع مستقر في جميع جوانب إقامتهم — من الحجز والدفع والتواصل ودعم الدخول إلى ما بعد الإقامة.

4. Property Owners: Engagement with Mustaqir4. ملاك العقارات: التعاقد مع مستقر

If you wish to have your property operated by Mustaqir, you represent and warrant that: إذا رغبت بأن تُدير مستقر عقارك، فإنك تُقر وتضمن ما يلي:

• You hold valid legal title to the property, or are an authorized representative of the legal owner, and have full authority to engage Mustaqir as operator;أنك تملك سند ملكية صحيح للعقار، أو أنك ممثل قانوني معتمد للمالك، وتملك الصلاحية الكاملة لتكليف مستقر بالتشغيل؛
• The property complies with all applicable Saudi laws and regulations, including but not limited to Saudi Tourism Authority licensing where applicable, municipal building codes, and any homeowner association rules;أن العقار يلتزم بجميع الأنظمة واللوائح السعودية، بما فيها — على سبيل المثال لا الحصر — تراخيص هيئة السياحة السعودية متى انطبقت، وأنظمة البناء البلدية، وأنظمة جمعيات الملاك؛
• The property is in safe, habitable, and clean condition suitable for short-term rental;أن العقار في حالة آمنة وصالحة للسكن ونظيفة وملائمة للإيجار قصير الأجل؛
• All information you provide to Mustaqir about the property (size, amenities, ownership documents) is accurate and complete;أن جميع المعلومات التي تقدمها لمستقر حول العقار (المساحة، المرافق، وثائق الملكية) دقيقة وكاملة؛
• You authorize Mustaqir to act as your agent for purposes of listing, marketing, contracting with Guests, collecting payments, and operating the property on the Mustaqir website;أنك تُفوّض مستقر بالعمل كوكيل عنك لأغراض الإدراج والتسويق والتعاقد مع الضيوف وتحصيل المدفوعات وتشغيل العقار على موقع مستقر؛
• You will maintain the property and address any maintenance or safety issues promptly when notified by Mustaqir;ستُحافظ على العقار وتُعالج فوراً أي مشاكل صيانة أو سلامة عند إبلاغك من قبل مستقر؛
• You acknowledge that Mustaqir has sole discretion over operational decisions (pricing, guest selection, calendar management) within the framework of the Property Management Agreement.تُقر بأن مستقر لديه السلطة المنفردة في القرارات التشغيلية (التسعير، اختيار الضيوف، إدارة التقويم) ضمن إطار اتفاقية إدارة العقار.

Onboarding of new properties is subject to Mustaqir's review and acceptance. Mustaqir reserves the right to decline any property or terminate any Property Management Agreement at its discretion in accordance with the agreement's notice provisions. يخضع إدخال أي عقار جديد لمراجعة مستقر وقبوله. ويحتفظ مستقر بالحق في رفض أي عقار أو إنهاء أي اتفاقية إدارة وفق تقديره ووفقاً لأحكام الإخطار المنصوص عليها في الاتفاقية.

5. Guests: Booking Properties5. الضيوف: حجز العقارات

As a Guest, when you submit a booking request and Mustaqir confirms it, you enter into a rental agreement directly with Mustaqir for the stay. By booking, you: بصفتك ضيفاً، عند تقديم طلب حجز وتأكيده من مستقر، تُبرم عقد إيجار مباشرةً مع مستقر للإقامة. وبالحجز فإنك:

• Agree to pay the listed price plus all applicable fees (cleaning fee, 15% VAT, any additional fees disclosed at booking);توافق على دفع السعر المُعلن مضافاً إليه جميع الرسوم المطبّقة (رسوم التنظيف، ضريبة القيمة المضافة 15%، وأي رسوم إضافية مُعلنة عند الحجز)؛
• Agree to abide by the house rules, check-in/check-out times, and any other terms specified at booking;توافق على الالتزام بقوانين المنزل ومواعيد الدخول والخروج وأي شروط أخرى مذكورة عند الحجز؛
• Confirm the guest count, identity of guests, and the purpose of the stay (personal/family residence — no commercial use unless explicitly authorized);تؤكد عدد الضيوف وهوياتهم وغرض الإقامة (سكن شخصي/عائلي — يُمنع الاستخدام التجاري ما لم يُصرّح به صراحة)؛
• Acknowledge that booking requests are subject to Mustaqir's approval and may be declined for any reasonable business reason.تُقر بأن طلبات الحجز تخضع لموافقة مستقر وقد تُرفض لأي سبب تجاري معقول.

6. Payments, Fees & Settlement6. المدفوعات والرسوم والتسوية

Payments are processed through licensed Saudi payment service providers regulated by the Saudi Central Bank (SAMA). Mustaqir does not store full card details. تتم معالجة المدفوعات عبر مزودي خدمات دفع سعوديين مرخّصين من البنك المركزي السعودي (ساما). لا يخزّن مستقر بيانات البطاقات الكاملة.

Guest payments: Guests pay Mustaqir directly. The price displayed at booking is the total amount payable by the Guest, inclusive of all stated fees and VAT. مدفوعات الضيوف: يدفع الضيوف لمستقر مباشرة. والسعر المعروض عند الحجز هو إجمالي المبلغ المستحق على الضيف، شاملاً جميع الرسوم وضريبة القيمة المضافة المُعلنة.

Owner settlement: Mustaqir remits the Owner's share of revenue to the Owner per the Property Management Agreement, less Mustaqir's management fee and any agreed deductions (e.g., maintenance, cleaning, marketing). تسوية الملاك: يُحوّل مستقر حصة المالك من الإيرادات إليه وفق اتفاقية إدارة العقار، بعد خصم رسوم الإدارة وأي خصومات متفق عليها (كالصيانة، التنظيف، التسويق).

VAT & ZATCA: Mustaqir issues ZATCA-compliant tax invoices to Guests for transactions where required. Saudi VAT (15%) is applied per applicable regulations. ضريبة القيمة المضافة وزاتكا: يُصدر مستقر فواتير ضريبية متوافقة مع هيئة الزكاة والضريبة والجمارك للضيوف عند الاقتضاء. وتُطبّق ضريبة القيمة المضافة السعودية (15%) وفق الأنظمة المعمول بها.

7. Cancellations & Refunds7. الإلغاء والاسترداد

Cancellation terms are set by Mustaqir per property and disclosed before booking confirmation. Refunds, when applicable, are processed back to the original payment method. يحدد مستقر شروط الإلغاء لكل عقار وتُعرض قبل تأكيد الحجز. وتُعاد المبالغ المستردة، عند الاستحقاق، إلى وسيلة الدفع الأصلية.

8. Prohibited Conduct8. السلوكيات المحظورة

You agree not to: توافق على عدم القيام بما يلي:

• Use Mustaqir or any property for any illegal purpose or in violation of Saudi laws;استخدام مستقر أو أي عقار لأي غرض غير مشروع أو يخالف الأنظمة السعودية؛
• Misrepresent your identity or the nature of your stay;تزييف هويتك أو طبيعة إقامتك؛
• Attempt to contact Owners directly to bypass Mustaqir's booking process;محاولة التواصل المباشر مع الملاك لتجاوز عملية الحجز عبر مستقر؛
• Use the property for any commercial, illegal, or harmful activity (parties, large gatherings, sub-letting) without explicit Mustaqir authorization;استخدام العقار في أي نشاط تجاري أو غير قانوني أو ضار (حفلات، تجمعات كبيرة، تأجير من الباطن) دون تصريح صريح من مستقر؛
• Discriminate against other users on the basis of race, religion, nationality, gender, or disability;التمييز ضد الآخرين على أساس العرق أو الدين أو الجنسية أو النوع أو الإعاقة؛
• Post false, misleading, defamatory, or offensive content (in reviews, messages, or otherwise);نشر محتوى كاذب أو مضلل أو مسيء (في التقييمات أو الرسائل أو غيرها)؛
• Attempt to access, scrape, or interfere with Mustaqir's technology, security, or operations.محاولة الوصول إلى تقنيات مستقر أو أمنها أو عملياتها أو التشويش عليها.

9. User Content & Intellectual Property9. محتوى المستخدم والملكية الفكرية

By submitting content (messages, photos for review, feedback) to Mustaqir, you grant Mustaqir a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and use that content in connection with operating and marketing Mustaqir's services. Owners' property photos submitted to Mustaqir for listing may be used by Mustaqir in marketing materials. بتقديم محتوى لمستقر (رسائل، صور للمراجعة، ملاحظات)، فإنك تمنح مستقر ترخيصاً عالمياً مجانياً غير حصري لاستضافة وعرض ونسخ واستخدام هذا المحتوى في تشغيل خدمات مستقر وتسويقها. والصور التي يقدمها الملاك لإدراج العقارات يجوز لمستقر استخدامها في موادها التسويقية.

The Mustaqir name, logo, website design, and brand are the property of Mustaqir and protected under Saudi intellectual property law. اسم مستقر وشعاره وتصميم موقعه وعلامته التجارية ملك لمستقر ومحمي بموجب قوانين الملكية الفكرية في المملكة العربية السعودية.

10. Suspension & Termination10. الإيقاف وإنهاء الحساب

Mustaqir may suspend or terminate your account at its discretion if you breach these Terms, engage in fraudulent activity, generate repeated complaints, or fail to comply with Saudi law. Termination of an Owner's Property Management Agreement is governed by the notice provisions of that agreement. You may close your guest account at any time by contacting customer support. يجوز لمستقر إيقاف حسابك أو إنهائه وفق تقديره إذا أخللت بهذه الشروط، أو انخرطت في نشاط احتيالي، أو ولّدت شكاوى متكررة، أو لم تلتزم بالأنظمة السعودية. ويخضع إنهاء اتفاقية إدارة عقار خاصة بالمالك لأحكام الإخطار المنصوص عليها في تلك الاتفاقية. ويمكنك إغلاق حساب الضيف في أي وقت بالتواصل مع الدعم.

11. Disclaimers & Limitation of Liability11. إخلاء المسؤولية وتحديدها

Mustaqir provides its services with due care and professional standards. However, to the maximum extent permitted by Saudi law: يُقدم مستقر خدماته بعناية واجبة ومعايير مهنية. ومع ذلك، إلى الحد الأقصى المسموح به بموجب الأنظمة السعودية:

• Mustaqir's total liability for any claim arising out of or in connection with these Terms or any stay is limited to the total amount paid for the relevant booking;إجمالي مسؤولية مستقر عن أي مطالبة ناشئة عن هذه الشروط أو عن أي إقامة محدودة بإجمالي المبلغ المدفوع للحجز ذي الصلة؛
• Mustaqir is not liable for indirect, consequential, or incidental damages such as loss of profits, data, or business opportunity;مستقر غير مسؤول عن الأضرار غير المباشرة أو التبعية أو العرضية مثل فقدان الأرباح أو البيانات أو فرص الأعمال؛
• Mustaqir does not guarantee uninterrupted, error-free, or perfectly secure operation of its website.لا يضمن مستقر تشغيل موقعه دون انقطاع أو أخطاء أو ثغرات أمنية بشكل مطلق.

12. Governing Law & Disputes12. القانون الحاكم والنزاعات

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms or use of Mustaqir's services shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia. تخضع هذه الشروط لأنظمة المملكة العربية السعودية. وأي نزاع ناشئ عنها أو عن استخدام خدمات مستقر يخضع للاختصاص الحصري للمحاكم المختصة في المملكة العربية السعودية.

13. Changes to These Terms13. تعديل الشروط

Mustaqir may update these Terms from time to time. Material changes will be notified via the website or by email. Continued use after such changes constitutes acceptance. قد يُحدّث مستقر هذه الشروط من وقت لآخر. يُبلَّغ المستخدم بأي تغييرات جوهرية عبر الموقع أو البريد الإلكتروني. يُعدّ استمرارك في الاستخدام قبولاً للتغييرات.
